These Terms of Use ("Terms") govern your use of the Vesper app ("Vesper", the "App"), provided by Outrun Cyber Dynamics LLC ("we", "us", "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
Vesper is a voice-first dream diary. You speak or type a dream, the App transcribes it and saves it to a journal on your device, and, on request, generates a reflective reading of the dream using artificial intelligence.
Vesper's readings are AI-generated reflections offered as a starting point for your own thinking. They are not predictions, diagnoses, or advice of any kind.
Readings do not constitute medical, psychological, legal, financial, or other professional advice, and they may be inaccurate or incomplete. Do not rely on them to make decisions, and do not use the App as a substitute for professional care. If you are concerned about your mental health or wellbeing, seek help from a qualified professional.
You keep all rights to the dreams you record. You grant us the limited permission needed to process your recordings and dream text solely to provide the App's features, such as transcription and readings, as described in our Privacy Policy.
You must be at least 13 years old to use the App.
You agree to use the App only for lawful purposes and in compliance with these Terms and all applicable laws. You agree not to misuse the App, interfere with its operation, or attempt to access it in an unauthorized way. This includes attempting to extract, manipulate, or override the instructions given to the AI models that generate readings, and using the App to generate content unrelated to your dreams.
The App offers an optional auto-renewing subscription ("Vesper Pro") that unlocks its premium features. The price and period are shown in the App before you buy. Payment is charged to your Apple Account or Google Play account at confirmation of purchase, and the subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. You can manage or cancel your subscription in your App Store or Google Play account settings at any time; deleting the App does not cancel it. Except where required by law, payments are non-refundable, and refund requests are handled by Apple or Google.
Your use of the App is also governed by our Privacy Policy, which explains how your information is handled.
The App, including its software, design, and content, is owned by us and protected by intellectual property laws. This includes the prompts and instructions that power Vesper's readings, which are our confidential proprietary content. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices that you own or control, as permitted by the applicable store's terms of service. You may not copy, modify, reverse-engineer, distribute, or create derivative works from the App except as permitted by law.
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that transcriptions and readings will be accurate.
To the maximum extent permitted by law, Outrun Cyber Dynamics LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of, or inability to use, the App, including any reliance on a reading. Our total liability for any claim relating to the App will not exceed the amount you paid us for the App or its subscriptions, if any.
If you obtained the App through the App Store: these Terms are between you and Outrun Cyber Dynamics LLC only, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App and is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, any claim that the App fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection or similar legislation. Responsibility for addressing such claims lies with Outrun Cyber Dynamics LLC.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Outrun Cyber Dynamics LLC, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
When using the App, you must also comply with any applicable third-party terms of agreement (for example, your wireless data service agreement).
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you obtained the App through Google Play: these Terms are between you and Outrun Cyber Dynamics LLC only, not with Google. Google is not responsible for the App or its content, and purchases and refunds through Google Play are also subject to the Google Play Terms of Service.
We may suspend or terminate your access to the App's online features if you violate these Terms, including by exceeding fair-use limits or misusing the AI features. You may stop using the App at any time. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.
We may update these Terms from time to time. Changes take effect when we post the updated Terms on this page. Your continued use of the App after changes are posted means you accept the revised Terms.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules.
