These Terms of Use ("Terms") govern your use of the Equals app ("Equals", the "App"), provided by Outrun Cyber Dynamics LLC ("we", "us", "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
Equals is a number-merging puzzle game. You tap cells on a grid to grow numbers; equal neighbors merge into bigger numbers, triggering cascades and chain reactions. The App works fully offline and offers optional integration with Apple Game Center and Google Play Games Services for leaderboards and achievements.
Any price for the App is shown in the App Store or Google Play before you download it. The App contains no in-app purchases, no subscriptions, and no advertising. Payments, if any, are processed by Apple or Google under their own terms, and refund requests are handled by Apple or Google.
Leaderboards and achievements are provided through Apple Game Center and Google Play Games Services, and your use of them is also subject to Apple's or Google's terms. You agree not to cheat, exploit bugs, use automation, or otherwise manipulate scores or achievements. We may request the removal of scores that we reasonably believe were obtained through such manipulation.
You must be at least 13 years old to agree to these Terms; if you are under 13, a parent or legal guardian must agree to them on your behalf.
You agree to use the App only for lawful purposes and in compliance with these Terms and all applicable laws. You agree not to misuse the App, interfere with its operation, or attempt to access it in an unauthorized way.
Your use of the App is also governed by our Privacy Policy, which explains how your information is handled. In short: Equals collects no personal information.
The App, including its software, design, and content, is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices that you own or control, as permitted by the applicable store's terms of service. You may not copy, modify, reverse-engineer, distribute, or create derivative works from the App except as permitted by law.
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that your locally stored scores and statistics will never be lost.
To the maximum extent permitted by law, Outrun Cyber Dynamics LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of, or inability to use, the App, including any loss of game progress, scores, or statistics. Our total liability for any claim relating to the App will not exceed the amount you paid us for the App, if any.
If you obtained the App through the App Store: these Terms are between you and Outrun Cyber Dynamics LLC only, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App and is not responsible for addressing any claims by you or any third party relating to the App, including product liability claims, any claim that the App fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection or similar legislation. Responsibility for addressing such claims lies with Outrun Cyber Dynamics LLC.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you, if any. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Outrun Cyber Dynamics LLC, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
When using the App, you must also comply with any applicable third-party terms of agreement (for example, your wireless data service agreement).
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you obtained the App through Google Play: these Terms are between you and Outrun Cyber Dynamics LLC only, not with Google. Google is not responsible for the App or its content, and purchases and refunds through Google Play are also subject to the Google Play Terms of Service.
We may suspend or terminate your license to use the App if you violate these Terms. You may stop using the App at any time. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.
We may update these Terms from time to time. Changes take effect when we post the updated Terms on this page. Your continued use of the App after changes are posted means you accept the revised Terms.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules.
